About Trust Deeds

We explain Scottish debt solutions in plain English and, only if you ask, pass your enquiry to a licensed insolvency practitioner firm. Here is who we are and who we are not.

Trust Deeds (trustdeeds.co.uk) is an information website and enquiry service for people in Scotland who are dealing with debt. We explain protected trust deeds and the other Scottish debt solutions in plain English. If you ask us to, we pass your enquiry to a licensed insolvency practitioner firm who can look at your options with you.

What we do

We do two things:

  • We publish plain-English guides to trust deeds, the other debt solutions available under Scots law, and your rights when creditors or sheriff officers take action. They are general information, written for people in Scotland, and checked against official sources such as legislation.gov.uk, the Accountant in Bankruptcy and mygov.scot.
  • We run a short enquiry form. If you want to talk your options through, you can answer eight questions. With your permission, we pass your answers to [Partner firm TBC], a firm of licensed insolvency practitioners, who will contact you. They should explain every option open to you, including ones that are not a trust deed.

What we are not

We are not a debt charity. If we introduce you to an insolvency practitioner or a debt advice firm, they may pay us a fee. This does not change what you pay.

To be clear about who we are:

  • We are not a charity or a not-for-profit organisation.
  • We are not a government body. We are not part of, or approved by, the Scottish Government, the UK Government or the Accountant in Bankruptcy.
  • We are not an insolvency practitioner. We do not arrange trust deeds ourselves. If you ask us to, we pass your details to a licensed insolvency practitioner firm, who will contact you.
  • We do not give debt advice. We do not recommend a trust deed or any other solution. Only someone who has looked at your full situation can do that.

You can always get free advice instead

You do not need to use our service. Free, impartial debt advice is available across Scotland, including from MoneyHelper, Citizens Advice Scotland and Advice Direct Scotland. Common questions

Are you a debt charity?

No. Trust Deeds is not a charity or a not-for-profit organisation. If we introduce you to an insolvency practitioner or a debt advice firm, they may pay us a fee. This does not change what you pay. Free debt advice is available from charities and other services in Scotland, and you can go to them directly.

Are you part of the government or the Accountant in Bankruptcy?

No. We are not connected to the Scottish Government, the UK Government or the Accountant in Bankruptcy. The Accountant in Bankruptcy is the Scottish Government agency that supervises trust deeds. You can read its guidance directly on its own website.

Do you give debt advice?

No. Our guides are general information, and we do not recommend any debt solution. If you want advice about your own situation, you can ask us to pass your enquiry to a licensed insolvency practitioner firm, or you can go straight to a free, impartial advice service.

Do you arrange trust deeds?

No. We do not arrange trust deeds ourselves and we are not insolvency practitioners. If you ask us to, we pass your details to a licensed insolvency practitioner firm, who will contact you and explain every option, including ones that are not a trust deed.
